@bison

Well here is my take on it, under buy back agreement, hyperion signed agreement that allowed hyperion to obtain the source code and object code to develop AmigaOS, the buyback agreement.

Now people say Amiga Inc never owned the source code, this means that they not only scammed Hyperion, but they scammed Haage and Partner.

So actually OS3.5 and OS3.9 also be illegal, but as no one sued Amiga Inc in 1998/1999 or during and no one ever complained about it when Hyperion was contracted to develop AmigaOS4.0.

And no one complained about when ownership was transferred from Gateway 2000 to Amiga Inc.

Cloanto never owned the source code, because if they did, they should have sued Amiga Inc, they never did. Claonto did have non exclusive licence to distribute Workbench disk with there emulation package.

And Hagge and Partner and Hyperion has acted in good faith. if however its proven they where scammed they should sue Amiga Inc and partners for damages. They should also sue Clanto for damages for not coming forward sooner. just imaging wasting 19 years before being told.

@NutsAboutAmiga

I think you meant shareholders, as the following clearly illustrates:

@NutsAboutAmiga

First of all, it's Haage and not "Hagge"... and secondly, no, that's not really what "people are saying", allthough there are always "some people" who say anything.

And thirdly... I never saw Hyperion acting in good faith, it's always been the same with them, even before OS4 there was "turbulence" over porting of games.

Does this qualify as an intimidating threat?

@Nonefornow

Perhaps?

For sure that e-mail (from the firm Monard Law, written by this lawyer) is a testimony of a certain ethical standard and a portrait of character.

Threats are mentioned in court documents. Jury trial.

Sorry if I missed some parts of this thread or referenced documentation, but if it is claimed A Inc doesn't own AOS source, who does then?

I think "Otherwise the gloves come off" is a hot candidate for another legendary Amiga phrase (on top of "Two more weeks" and "On schedule and rockin'")

@thread

The "you own this stuff, but give it to me or" part of this is amusing, but it's the rest of the document that interests me. First thing is the date of these emails February, 2017.

Bill says he'll send Ben's mail to the shareholders because:
Quote:
I have no legal capabilities of signing any rights to anyone.

Ben says:
Quote:
I know that Reed Smith is no longer handling this

then Bill says:
Quote:
Reed Smith is not representing Amiga, but they do represent the estate of the largest shareholder the estate of Pentti Kouri.

So, I go back and read my older thread to remind myself this was all known years before:
The Closing of Pentti Kouri's Estate

I'm confused because it's been public knowledge for years before this email exchange that this was all about Pentti Kouri's estate and the Reed Smith lawyers who were handling it, after John Grzymala lost that job due to the passing of Pentti Kouri.

Perhaps this was just all about confirming that, but it sure seemed like a weird exchange to me in these mails.

Perhaps this exchange between Olaf Barhel and myself is even more relevant today than it was in May, 2017:

That depends on what version of what component of AmigaOS you are talking about, the list of claimed "pwners" is long.

Which means that hiring "friendly litigators" to track down former execs or officers of a company would be a colossal waste of time and money, since it appears that such former execs or officers do not have binding authority.

Probably common knowledge to many but how did Dr. Pentti Kouri get introduced to Amiga as an investment?

@HyperionHolding

Thank you for trying to consolidate all the Amiga licenses, copyrights and what not which comes with it.

The best way to see who owns the AmigaOS source code it to put it on Github and see who sues.
