News   News : Amiga inc retain Amiga Trademark
   posted by Mikey_C on 9-Sep-2003 17:11:48 (5466 reads)
A dispute arose late May over the status of the AMIGA trademark

That dispute has now been resolved and once again Amiga inc retain their trademarks

It transpires that back in May 2003 this year, an oversight, led to Amiga losing their TradeMarks.

Genesi quickly filed for application of Amigas TradeMarks.
However with the Trademarks returning to the original owners, a win of the rights to the trademarks by anyone else is now unlikely.

APOLOGIES TO EVERYONE

Unfortunately I had no option but to remove all the posts on here.

This is a clear case of a unwelcome minority spoiling it for everyone else.

I brought this news item back onto the front page because, news shouldn`t be censored. AmigaWorld is here to provide a service to the Amiga Community. Plus of course, removing this Item from the front page would have been a win for the Anti-Amiga Brigade.

I am sorry that I had to remove all the posts on here, but felt I had no choice,

Mikey C

Ok, back on topic then, questions:

What were the risks of Amiga Inc losing the trademark in the first place?

What do you have to do in order to keep a trademark?

Ben Hermans already explained that there was no real danger of the Amiga trademark ending up into malicious hands due to this neglect.

Quote:

According to the US patent and trademark office:

"Rights in a federally-registered trademark can last indefinitely so long as the owner continues to use the mark to identify its goods or services and files all necessary documentation in the United States Patent and Trademark Office."

@Mike_B

I must have missed that explanation. Do you have a link?

Id like to follow the logical argument, whilst Id take his word for it
and find more out about the whys and hows myself.

@ Miffy

Here's an earlier quote from Ben Hermans with regard to the US market (also note that in Europe the trademark was still properly registered):

Quote:
All of this uproar is completely unfounded.

Amiga can on the basis of its tradename alone oppose any use of the Amiga trademark by other parties.

Tradenames do not require any prior registration.

Moreover, US trademark law also recognise "common law" trademarks which also do not require registration.

In short, I'm seeing a lot of fuss about nothing .

To the extent that the quoted database is even up to date, the fact that are or are not registered there doesn't prevent you from having a perfectly valid "common law" trademark under US law.

Well done Mikey!

As said, it's getting tiring reading the same again and again.

No reflection on your good charecter
