Amiganews.de reports that Amiga Inc. has registered two copyright marks in Germany last year:

- First one is named AMIGA ENABLED (register number publishes 30653991,8) on 15 December 2006.
- Second one is named AMIGA ANYWHERE (nr. 30653845,8) on 22 dec 2006 .

In the past year there were transferred these marks from Amiga Development LLC which was a subsidiary firm controlled Gateway:

Personal consideration:

IMHO The mark "Amiga Enabled" sounds me strange.

Seems to me a mark to be added to brand new third party hardware "ready" and "enabled" to run Amiga OS.

It must be referring to the old address of "Amiga LLC" from "Gateway times":

600 North Derby Lane, North Sioux City, SD 57049

I always thought that this location was no longer being used since 2002/2003.

Quite a number of trademarks were filed under this address, most of them in 1999.

Don't know if
these trademark changes have been posted somewhere already (I start getting confused from all this stuff).

If you go out to buy product for windows vista, you make shore it is Windows Visa Enabled, or else you might end up whit product that do not support your operating system.

I think Amiga Inc is just copying this idea, so in other words they are going to be selling stickers saying Amiga enabled to hardware vendors, most likely any product that runs AmigaOS or Amiga Anywhere.

It might look like they have changed there licence system from product most be branded Amiga some thing to product most be Amiga classified, this makes sense when a product already has brand of it own, and also makes sense if they like to have different competing hardware vendors.

OK. Here's the situation:

Amiga has registered their interest in various marks around the world. They are required to, to make it easier to prosecute. It's simply a formality. Involves filing a form. Takes about 30 minutes.

They have registered a couple of new marks around the world. They have more than likely filed a Madrid Protocol application allowing them to register the trademark in many different countries. So, just because it's registered in the Czech Republic for example - it doesn't mean there is any specific reason. They may have just ticked that box on the form.

In reality all these procedures are performed by Attorney's, Amiga would have asked them to file trademarks around the world, the firm will have told them how much and then done it for them. Really, it would be a minor consideration by Amiga, it's unlikely a lot of planning went into which countries to register in, it's common to just register in the "major" countries.

How do I know all this? I'm a Trade Mark Attorney.

Heh, heh, heh...

I conclude that if Ainc has let the community, website, progress all wither on the grapevine, then they are in over their heads and broke and basically are sunk as a business.

SO, good question, why update their rights? I mean, they've let everything else languish and the rights, in my opinion, are only as strong as everything else is (awareness of the brand, a following of potential customers etc). Example: Did those Commodore MP3 players a couple of years ago make a splash? NOT! If Apple went BUST tomorrow and miraculously came back in 6 months with Ipod, they'd sell. JUST an example.

Amiga's value drops every passing day of do-nothing management and I think Ainc don't have a lot of money but they chose to update their rights. What are those rights REALLY worth? Hmmmm? Worth the monetary risk of globally updating them to.....

THAT's the headline part! To DO WHAT precisely? OS4 is pretty much done. Hardware, I think, is being developed. So I think they are going to finally sell product or sell themselves.

Sure they could continue to gather dust with a losing value brand registered all over, but I don't think they are that stupid... I hope.

Oh... darn. I thought it cost a lot of money to do this?

Wonder how much it would have cost? Here I thought getting trademarks and copyrights were expensive...
