Hyperion Entertainment CVBA is pleased to announce that on September 30, 2009, it has reached a comprehensive settlement agreement with Amiga, Inc., Itec LLC and Amino Development Corporation, Inc., to bring all ongoing litigation and worldwide pending procedures between the parties to an end.

I'm confused how Amiga can lose the rights to their own OS. They must have financial difficulties or something, I just don't see how the OS in its entirety (beyond OS4 - which admittedly Hyperion should rightfully own), would be handed over. Most bizarre. If I were Amiga, I would have SOLD the whole shebang, lock, stock and barrel instead of keeping hold of the parts that don't mean a great deal (unless their patents are bringing in revenue?)

I guess Amiga Inc took on Hyperion in a SCO vs IBM style lawsuit, and the party with deepest pockets (or smartest lawyers) won.

Hyperion staff have been openly critical of the merits of an official port to Mac Mini. I don't see why this should change now.

After all, the legal dispute didn't stop ports to Sam & Peg...

Loss of Pentti Kouri was a blow.

Nah !!!

It was probably just the bankruptcy clause in the original (Nov 2003) contract.

Gratulations, i wait bloody long years for it!

I hope the best for Hyperion and Amiga OS4.1.

My personal choice for using only Amiga OS4.1 at home was decided month ago. And it seems now it was a wise change

According to HyperionMP Amiga did not lose the rights:

So Amino/Amiga/somebody owns the OS and Hyperion got an exclusive license to 3.1 and to NG developments.

Agreed... however, the statement from Hyperion is definitive and there is no indication of any degree of concession. The original court case basically went from a trademark infringement issue to a complete transfer of ownership.

Others have speculated that Amiga is imploding and simply phoned this one in. I have a feeling that they're right.
