| Ah, wonderful news! I had the feeling that Hyperion would win with the law in the hands, and Amiga Inc needs to find or ask Hyperion for a license agreement to use the source codes of AmigaOS 4 to do AmigaOS 5.
Very promising! Congratulation, Hyperion! I will make a comment on this in the following days on YouTube _________________ Probably Pegasos 2 G4 1Ghz 1GB DDR-system, ATI Radeon 9250, ESI@Juli PCi-soundcard, all running AmigaOS 4.1 with latest updates, or a new powerful Amiga! Fingers crossed!

No, I don't think so.
Quote:
Within the framework of the settlement agreement Hyperion is granted an exclusive, perpetual, worldwide right to AmigaOS 3.1 in order to use, develop, modify, commercialize, distribute and market AmigaOS 4.x (and subsequent versions of AmigaOS including without limitation AmigaOS 5) in any form, on any medium and for any current or future hardware platform under the exclusive trademark "AmigaOS" (Amiga operating system) and using other associated trademarks (such as the "BoingBall" logo). Hyperion will continue development and distribution of AmigaOS 4.x (and beyond) as it has done since November of 2001.o |
It looks like Hyperion have the exclusive right to continue the development of AmigaOS in perpetuity, forever, and indefinitely and on any platform they choose. AInc. would have to buy a licence in order to develop an AOS 5. What is more, they appear to have no rights to the AOS 4 code. All they have is the rights to OS3.1 (3.5 and 3.9 having evaporated in the hands of certain other developers I could mention).
Oh happy dancing banana day!

| WOW !!! That was unecpected ! Very good news indeed !
Now, I wonder...... What the terms for Ainc were, If Hyperion had to pay anything to Ainc, If Bill McEwen or anyone else is an shareholder or something, If Hyperion got any (if existent) code allready written by Ainc to OS5, and last but not least what is Hyperion going to do in this new situation ?
Great
Thumbs up to Hyperion !

| A very good day for AmigaOS!!!
Now, we DO need that http://www.amigaos4.com makes its comeback with all its previous content.
It is very important to have an official website for people outside

| Haha, this is great news indeed!
A question: Does this also give Hyperion the rights to kickstart 3.1 as well? I'm thinking in terms of licenses for the minimig and natami, etc. _________________

| Is ACK Software Controls still official OS4 hardware partner? At least not the only one anymore, I guess... I guess Troika will also finally get a license
As Hyperion will also develop the next major version instead of Amiga inc, has the "Better than MacOS X" AmigaOS (both rights and source code) been transfered to Hyperion? Last edited by Jupp3 on 18-Oct-2009 at 10:39 AM.

| Its interesting that Hyperion is now a CVBA and not VOF...think this is a co-operative company in Belgium corporate law.
Wonder what the terms of the agreement were? Has A-inc joined forces by taking ownership of part of the company? That would be one way to settle the argument - and might I add, could have happened years ago without both companies draining themselves of their cash!! |

| And God is using an Amiga. That must justify the justice of this victory for Hyperion Entertainment Group _________________ Probably Pegasos 2 G4 1Ghz 1GB DDR-system, ATI Radeon 9250, ESI@Juli PCi-soundcard, all running AmigaOS 4.1 with latest updates, or a new powerful Amiga! Fingers crossed!
