Hyperion Entertainment CVBA is pleased to announce that on September 30, 2009, it has reached a comprehensive settlement agreement with Amiga, Inc., Itec LLC and Amino Development Corporation, Inc., to bring all ongoing litigation and worldwide pending procedures between the parties to an end.

Ah, wonderful news! I had the feeling that Hyperion would win with the law in the hands, and Amiga Inc needs to find or ask Hyperion for a license agreement to use the source codes of AmigaOS 4 to do AmigaOS 5.

No, I don't think so.

It looks like Hyperion have the exclusive right to continue the development of AmigaOS in perpetuity, forever, and indefinitely and on any platform they choose. AInc. would have to buy a licence in order to develop an AOS 5. What is more, they appear to have no rights to the AOS 4 code. All they have is the rights to OS3.1 (3.5 and 3.9 having evaporated in the hands of certain other developers I could mention).

Very good news indeed !

Now, I wonder......
What the terms for Ainc were, If Hyperion had to pay anything to Ainc, If Bill McEwen or anyone else is an shareholder or something, If Hyperion got any (if existent) code allready written by Ainc to OS5, and last but not least what is Hyperion going to do in this new situation ?

A question: Does this also give Hyperion the rights to kickstart 3.1 as well? I'm thinking in terms of licenses for the minimig and natami, etc.

Is ACK Software Controls still official OS4 hardware partner? At least not the only one anymore, I guess...
I guess Troika will also finally get a license

As Hyperion will also develop the next major version instead of Amiga inc, has the "Better than MacOS X" AmigaOS (both rights and source code) been transfered to Hyperion?

Its interesting that Hyperion is now a CVBA and not VOF...think this is a co-operative company in Belgium corporate law.

Wonder what the terms of the agreement were? Has A-inc joined forces by taking ownership of part of the company? That would be one way to settle the argument - and might I add, could have happened years ago without both companies draining themselves of their cash!!
